Apple vs Epic: attenti alle tonnellate di informazioni sbagliate: e' veramente libero il pagamento in app ?

La disinformazione e' folle.

In questo momento le testate italiane (che ho bannato dai miei browser), stanno pubblicando un documento di una paginetta che dice qualcosa di ben diverso dai loro articoli.

Il documento completo e' di 185 pagine.

Si tratta di una ingiunzione che il giudice impone ad Apple e direttamente ai suoi dipendenti, fornitori, collegati a qualasiasi titolo perche' non blocchino le app che, OLTRE al meccanismo di Apple ha anche uno proprio per incassare, ma anche solo un link ad un contatto per concludere la vendita tramite comunicazione diretta con lo sviluppatore.

La decisione entra in vigore in 90 giorni e puo' essere impugnata prima. Cosi' presentata sembra applicarsi a chiunque ovunque.

Naturalmente e' falsa e fuorviante l'affermazione, che i giornali italiani uniformandosi danno, che Apple non e' un monopolista.

La decisione del giudice lo dice chiaramente: Apple viene condannata per posizione dominante nel suo mercato di riferimento (stiamo parlando di videogiochi, epic, c'e' molto di piu' del solo mercato mobile)

" Monopoly power under the first element can be defined as “the power to control prices or exclude competition” and may be inferred from the defendant’s predominant market share in the relevant market. "

Per quanto il testo riporta 100 volte monopolio e 7 posizione dominante:

The second and “more common type of proof is circumstantial evidence pertaining to the structure of the market.” Id. To demonstrate market power indirectly, a plaintiff must: “(1) define the relevant market, (2) show that the defendant owns a dominant share of that market, and (3) show that there are significant barriers to entry and show that existing competitors lack the capacity to increase their output in the short run.” Id.594 Because “[a] mere showing of substantial or even dominant market share alone cannot establish market power sufficient to carry out a predatory scheme,” a plaintiff “must show that new rivals are barred from entering the market and show that existing competitors lack the capacity to expand their output to challenge the predator’s high price.” Rebel Oil Co., 51 F.3d at 1438–39, n.10 (“telltale factors” include “market share, entry barriers and the capacity of existing competitors to expand output”). Entry barriers are market characteristics “that prevent new rivals from timely responding to an increase in price above the competitive level.” FTC v. Qualcomm Inc., 411 F. Supp. 3d 658, 684 (N.D. Cal. 2019) (quotation marks omitted), rev’d on other grounds, 969 F.3d 974 (9th Cir. 2020). They include “additional long-run costs that were not incurred by incumbent firms but must be incurred by new entrants,”


Ma non sono provati comportamenti predatori

Because “[a] mere showing of substantial or even dominant market share alone cannot establish market power sufficient to carry out a predatory scheme,” a plaintiff “must show that new rivals are barred from entering the market and show that existing competitors lack the capacity to expand their output to challenge the predator’s high price.” Rebel Oil Co., 51 F.3d at 1438–39, n.10 (“telltale factors” include “market share, entry barriers and the capacity of existing competitors to expand output”). Entry barriers are market characteristics “that prevent new rivals from timely responding to an increase in price above the competitive level.” 


In breve il mondo anglosassone mette al centro di una condanna la condotta predatoria, non solo la posizione dominante. Uno schema non comparabile con i nostri.

Il punto dei costi d'ingresso nel mercato sono ugualmente rilevanti.

Quindi ?

E' una ingiunzione quella enfatizzata dai giornali, ma il documento completo qui linkato riguarda l'ordine contro Epic.

Insomma: non ci saranno rivoluzioni. il 15% per i servizi di incasso e la presenza della app all'interno dello store sono accettabili solo per contenuti.

Diciamolo chiaramente, il tema non e' questo. Il tema e' quali app vengono spinte dagli store e quali no.

Ce ne sono troppe ottime che non si scoprono mai. Questo e' il male.

Quando venivano venduti i computer negli anni '80 i produttori facevano di tutto per spiegare come usarli liberamente.

Oggi i produttori difendono in tribunale la scelta di nascondere agli utenti come funzionano i computer. Usateli come diciamo noi, perche' solo cosi' sono sicuri.
